Trademark Registration in Jaipur
A registered trademark protects your brand name, logo or slogan. We help you check availability, file the application in the right class and respond to objections.
What can be registered
A word, name, logo, slogan, device, shape or combination of colours that distinguishes your goods or services from those of others. Marks that are generic, purely descriptive or deceptively similar to an existing mark may be refused.
Process and timeline
- Search – we search the Trade Marks Registry for identical or similar marks before you invest in a brand.
- Filing – the application is filed in the relevant class or classes of goods and services. You may use the ™ symbol once the application is filed.
- Examination – the Registry may raise objections, which need a written reply and sometimes a hearing.
- Publication – the mark is published in the Trade Marks Journal, and third parties may oppose it within four months.
- Registration – the certificate is issued, and the ® symbol may be used.
Registration commonly takes a year or more, and longer where there are objections or an opposition. A registration is valid for ten years and can be renewed.
Documents required
- Applicant’s name, address and legal status; for companies and LLPs, the incorporation certificate.
- The mark: name in text form, or the logo in image form.
- A description of the goods or services, and the date from which the mark has been used, if already in use.
- Udyam or Startup recognition, where available, since a reduced government fee applies to eligible startups, individuals and small enterprises.
Frequently asked questions
What is the difference between ™ and ®?
The ™ symbol can be used for a mark you claim as your trademark, including when an application is pending. The ® symbol may be used only after the mark is registered.
Can I register a trademark for my company name?
Registration of the company name with the Registrar of Companies does not give trademark rights. A trademark application is separate, and is worthwhile for the brand names you use.
Does a trademark registration cover the whole world?
A registration in India protects the mark in India. Protection in other countries needs separate filings, for example through the international system, which we can help you plan.
